Limit of Liability

By submitting film, negatives, slides, digital files, or any media to Memphis Film Lab, the customer agrees to the following terms and limitations of liability:

  1. Risk of Loss or Damage
    Memphis Film Lab takes great care in handling all materials. However, due to the inherent risks involved in film processing and handling, including but not limited to equipment malfunction, chemical processing errors, or loss during transit, the customer agrees that the company’s liability for any loss, damage, or destruction of film, media, or digital files shall be limited.

  2. Maximum Liability
    In the event of loss or damage to any film or media submitted, whether due to negligence, accident, or other cause, the customer agrees that Memphis Film Lab’s liability is limited to the replacement cost of the raw materials—namely, an equivalent amount of unexposed film or storage media. The company is not liable for any claimed or perceived sentimental, emotional, professional, or commercial value of the content.

  3. No Responsibility for Content
    Memphis Film Lab does not review or inspect the content of submitted media. The customer accepts full responsibility for ensuring they retain backups of all digital files and/or duplicates of irreplaceable materials before submitting to us. We are not responsible for corrupted files, underexposed or overexposed images, or any other issues inherent to the original materials submitted.

  4. Turnaround and Delivery
    While we strive to meet estimated turnaround times, these are not guaranteed. We are not liable for delays caused by mail carriers, weather, or other factors beyond our control.

  5. Customer Indemnification
    The customer agrees to indemnify and hold harmless Memphis Film Lab, its employees, contractors, and affiliates from any and all claims, damages, or legal actions arising from materials submitted, including copyright infringement, unlawful content, or violation of privacy rights.

  6. Acceptance of Terms
    By submitting materials to Memphis Film Lab, the customer acknowledges they have read, understood, and agreed to these terms of service, including the limitation of liability.
